Supreme Court lets Trump fire FTC commissioners
In January of last year, Trump fired FTC Commissioners Rebecca Slaughter and Alvaro Bedoya, without citing causes for termination.
The Supreme Court on Monday allowed President Donald Trump to fire two commissioners of the Federal Trade Commission (FTC), finding that a "for cause" provision ran afoul of the constitutional separation of powers.
"Although it is up to the Senate to decide whether to confirm those with whom the President would prefer to work, neither Congress nor the courts may saddle him with those with whom he cannot work," the Court wrote. "Subordinates who exercise the President’s power are subject to removal by him. Then, and only then, can they remain accountable to the President, and the President to the people."
In January of last year, Trump fired FTC Commissioners Rebecca Slaughter and Alvaro Bedoya, without citing causes for termination. The case proceeded through the lower courts, leading to the Trump administration's appeal.
Chief Justice John Roberts authored the majority opinion, which was 6-3. Associate Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented.
The decision appears to hand Trump sweeping authority to remove executive agency employees.
